Tim Dibden, for Dempsey, on Wednesday asked the Adelaide Magistrates Court to release his client on home detention bail, a move not opposed by police but Magistrate Elizabeth Sheppard denied the request.Dempsey, 34, is yet to plea to charges of recklessly causing harm and causing harm with intent to police officers.The court heard police were called to Robsart St, Parkside, on November 8, 2020, where Dempsey was allegedly damaging wing mirrors on cars.Prosecutors told the court Demspey allegedly gave a false name to officers and ran off before returning to collect some chocolate he left behind.The prosecutor said he was then arrested before he allegedly “lashed out at the officers”, punching one in the mouth causing a split lip, knocking one tooth out and another into his gum.“It’s possible that his two front teeth will need to be removed,” she said.The other officer suffered bruising and a torn knee ligament.At the time, police said a stand-off with Dempsey involved STAR Group officers and lasted three hours.In refusing his release on bail, Ms Sheppard said the allegations against Dempsey were serious and had been caught on CCTV.“Parliament has made it pretty clear that this sort of offending leads to a person not being released on bail unless special circumstances are established,” she said.“I’m not convinced special circumstances are made out in this case so I’m against the application.”Dempsey will return to court next month.
